The Nigerian Electricity Regulatory Commission (NERC) has issued order transferring regulatory oversight of the electricity market in Nasarawa state to the state owned Nasarawa State Electricity Regulatory Commission (NASERC).
This is in compliance with the provisions of Constitution of the Federal Republic of Nigeria (CFRN) and the Electricity Act 2023 (Amended) (EA 2023).
NERC however, gave conditions to be met before effective assumption of responsibilities by the NASERC.
The conditions contained in the order include that Abuja Electricity Distribution Plc (AEDC) should incorporate a subsidiary (AEDC SubCo) to assume responsibilities for intrastate supply and distribution of electricity in Nasarawa State from AEDC.
Also, AEDC shall complete the incorporation of AEDC SubCo within 60 days from 4th August 2025. The subcompany shall apply for and obtain licence for the intrastate supply and distribution of electricity from NASERC, among other directives.
AEDC shall create an Asset Register of all its power infrastructure located within Nasarawa State, evaluate and apportion contractual obligations and liabilities attributable to AEDC’s operations of its subsidiary in Nasarawa State.
Further AEDC shall identify all the applicable trading points for energy offtake for the operations of AEDC SubCo in Nasarawa State.
AEDC shall identify the actual geographic boundaries of Nasarawa State and carve out its network in Nasarawa State as a standalone network with the installation of boundary meters at all border points where the network crosses from Nasarawa State into another state.
These and other conditions were enumerated by NERC in its Order No: NERC/2025/092 jointly endorsed by the NERC Vice Chairman, Musiliu O. Oseni and Commissioner, Legal, Licencing and Compliance, Dafe C. Akpeneye, dated August 1, 2025.
All transfers envisaged by this order shall be completed by 3rd February 2026.
