The Kano Upper Shari’a Court has dismissed the case against Auwalu Danladi Sankara, the suspended Jigawa state Commissioner for Special Duties, who was accused of enticing a married woman, Tasleem Baba Nabegu.
The Presiding Judge Ibrahim Sarki Yola, at the court’s sitting on Monday terminated the case due to lack of evidence, as contained in the reports by the AIG Zone 1, Kano, and Kano Attorney General and Commissioner of Justice.
The case was filed by Nasiru Buba,Nabegu’s husband, who accused Sankara of having an illicit affair with his wife,
However, while delivering his ruling, Sarki Yola emphasised the need for thorough and cautious investigations by law enforcement and regulatory bodies like the Hisbah Commission.
He noted that allegations against prominent individuals must be handled with care to avoid unnecessary tarnishing of reputations.
‘Following the investigation by the office of the Assistant Inspector General of Police, the report shows there is no evidence to prove that there was any illicit affair between Auwal Danladi Sankara and Tasleem Baba Nabegu,” the judge stated.
The court observed that the complainant and his legal representatives failed to appear to contest the police findings.
‘This case field against Taslim Baba Nabegu and Auwalu Danladi Sankara lacks merit and any reliable evidence for the court to proceed with. Therefore the case is here by strike out, the first and Second defendants are also discharged “, the judge declared.
Reacting after the court judgement, the counsel to the first defendant Taslim Baba Nabegu (the wife of the complainant) Barrister Rabiu Shuaibu Abdullahi said they are satisfied with court judgement.
Similarly the counsel to the second defendant Saddam Suleiman Shehu said, the outcome of the court judgement has proved Sankara as innocent of all the allegations label against him.
“We are studying the outcome of the judgement, and the suspected political witch-hunting around it for further action ” the defendants counsel stated.
Governor Umar Namadi, had on October 20 ordered Sankara’s suspension following allegation by Kano Hisbah Board that he (Sankara) was allegedly caught in a compromising position with a married woman.
Sankara’s suspension was announced in a statement by the Secretary to the State Government, Bala Ibrahim.
He said the suspension was made to allow for an unfettered investigation into allegations made by the Kano State Hisbah Board.
It would be recalled that Sankara was on October 19 arrested in an uncompleted building in the company of a married woman.
The Director -General of the Board Abba Sufi, had in a statement said the suspended commissioner’s arrest followed a complaint by the woman’s husband, accusing Sankara of improper conduct.
Reacting to the development, the Jigawa State government said the claims by Hisbah necessitate a thorough examination to uphold the integrity of the state administration.
The SSG said Governor Namadi was commited to accountability and ethical standards in governance.
“The suspension is a precautionary measure intended to facilitate a fair investigation.
“We take all allegations seriously and are dedicated to upholding the trust of Jigawa citizens in the government,” Mr Ibrahim said in the statement.
