NERC Reserves Ruling On Petition Against Ikeja, Eko DisCos By Lagos Hoteliers Over Alleged Arbitrary Billings

The Nigerian Electricity Regulatory Commission (NERC), has reserved ruling on petition by the Hotel Owners and Managers Association of Lagos (HOMAL) over alleged arbitrary billings and lack of consultation by Ikeja and Eko DisCos.

The HOMAL led by its Director General, Adeniyi Ologun, and its legal representative, Prof. Adeola Sanni SAN, had further claimed that there had been two Supplementary Multi-Year Tariff Orders (MYTO) approved by NERC in April 2024 and May 2024, before which there was no consultations with them by the two DisCos operating in Lagos.

They cited a lack of consultations by the respective Distribution Companies (DisCos) before the tariff methodology was reviewed, among other issues.

But while making clarifications, the Vice Chairman of NERC, Dr. Musiliu Oseni, who doubles as the Chairman of the Petition hearing panel, explained that “there was no arbitrariness in the tariff review and that all procedural actions were taken, including stakeholders’ consultations – the rate case hearing.”

He also stressed that ” the current methodology which is the MYTO has not been reviewed contrary to the position of the petition; parameters that include foreign exchange rates and inflation formed the inputs”, according a post on NERC verified Facebook Account.

The panel which observed that the petitioners did not even join the DisCos in their petition when their complaints were about them, however, promised that “The Commission will make a ruling that will address the issues around the type of tariff review, the basis for the review, and the procedures for implementing the existing tariff methodology.”

Though, no date was specifically mentioned for the ruling.
