
****Berates Justice Nyako Of Being Ignorant Of Law
The Leader of the Indigenous People of Biafra (IPOB), Mazi Nnamdi Kanu, has berated Justice Binta Nyako for being ignorant of provisions of the Nigerian Constitution.
Kanu contended that the offence of self determination which he is currently standing trial Nigeria, is not provided in 1999 Constitution of the Federal Republic of Nigeria.
Kanu in his verified Twitter handle @MaziNnamdiKanu, stated that
“Section 36 sub-section 12 of the Nigerian Constitution PROHIBITS trial and conviction of anybody in a Nigerian court of any offence not written down. Secession or self-determination is not written down as an offence in Nigeria. Binta Nyako is ignorant of the law.”
Chapter 4 which deals with Fundamental Rights, Section 36 (sub-section 12) of the 1999 Constitution provides: “Subject to otherwise provided by this constitution, a person shall not be convicted of a criminal offence unless that offence is defined and the penalty therefor is prescribed in a written law, and in this subsection, a written law refers to an Act of the National Assembly or a law of a state, any subsidiary legislation or instrument under the provisions of a law.”
Kanu had through the same Twitter handle accused Justice Nyako of collaborating with the Federal Government in an alleged plot to assassinate him by granting him bail in 2017.
He said: It’s now obvious Justice Binta Nyako only agreed to grant me bail as part of an elaborate ploy with the Nigerian govt to set me up for assassination. Her failure to investigate the military invasion of my home is clear confirmation that she is angry I survived the attack.”
Few weeks ago, Justice Nyako had revoked the bail granted to Nnamdi Kanu in 2017 and subsequently order for his arrest for jumping bail since Kanu had not appeared in court after being bailed.
It would be recalled that Kanu vanished from his home in Umuahia when the Nigerian military invaded his compound while executing “Operation Python Dance Two”
However, he reappeared a year later in Israel in November, 2018 from where he was said to have gone back to United Kingdom.
Ever since the Nigerian soldiers invaded the family home, Kanu’s parents have neither been seen nor their whereabouts known.
